The defendant, a foreign corporation, is an insurance company organized on the assessment plan. The plaintiff, J. J. Howard, a resident of the State, insured his life in defendant company for the benefit of the plaintiff J. M. Howard, and at the time the application was accepted, a “certificate of membership” was issued, in which the defendant agreed and promised to pay to the beneficiary the value of the policy upon the death of the plaintiff J.
