This is an action under the Federal Employers’ Liability Act (45 U. S. C. A. Sec. 51, et seq.) to recover damages for personal injuries. Plaintiff recovered a judgment for $37,000.00 and defendant has taken this appeal.
Since it js conceded that the evidence was sufficient to make a submissible case on appellant’s liability, there is no reason to state the evidence in detail. Bespondent was employed by appellant as a member of a bridge and building crew.
