SIBLEY, Circuit Judge.
Euphemia L. Kelliher, joined by her husband, brought trespass quare clausum fregit against Stone & Webster, Inc., for entering upon certain lands of hers on the water front of Hillsborough Bay, Fla., and there depositing earth and constructing a causeway and dykes, to the great damage of the land. A plea of not guilty was filed, and one that' the only part of the land entered was a public street of the city of Tampa and that the work was done under the city’s license to improve the street.
