James Dalton, the claimant, was injured on May 24, 1926, by an accident arising out of and in the course of his employment by the city of Yonkers. At that time he was a member of the State Employees’ Retirement System under the Civil Service *322Law. He made claim for workmen’s compensation and on November 9,1926, was awarded 160 weeks’ compensation at twenty dollars per week for the total loss of his right eye and the case was closed.
