I agree that the district court abused its discretion, and accordingly, I would reverse, but because I disagree with the majority’s analysis and its instructions to the district court, I do not join the majority opinion. The district court’s decision, though flawed, was limited to the threshold issue of the timeliness of the Unions’ intervention. In contrast, the majority’s decision strays far afield from the decision on appeal and instructs the district court as to how to conduct its proceedings with respect to the underlying issues, even though issues pertaining to “limited intervention”…
