ANDERSON, Justice.

Judgment in the case was rendered and entered August 29, 1956, in the district court of the 145th Judicial District, Nacog-doches County, on a directed verdict. On September 8, 1956, appellants filed written notice of appeal. At 10:45 a. m., on September 28, 1956, they filed an appeal bond which was duly approved. In the afternoon of the same day, September 28, 1956, they filed a motion for new trial.
