OPINION

McDONALD, Chief Justice.

This is an appeal by appellant Bernal from an order of the trial court entered January 6, 1971, granting appellee insurance company a nonsuit, and from the re*642fusal of the trial court to grant appellant’s motion to reinstate.

Appellee filed this suit in the District Court December 4, 1970, to set aside an award of the Industrial Accident Board to appellant. Appellant answered by general denial on December 28, 1970.
