OPINION ON APPELLANT’S PETITION FOR DISCRETIONARY REVIEW
BAIRD, Judge.
Appellant was convicted by a jury of the offense of capital murder pursuant to Tex.Penal Code Ann. § 19.03(a)(2). The State did not seek the death penalty and the trial judge sentenced appellant to life imprisonment. Tex.Code Crim.Proc.Ann. art. 37.071(1). The Court of Appeals affirmed. Price v. State, 870 S.W.2d 205 (Tex.App.—Fort Worth 1994).
