ORDER DENYING PETITION FOR WRIT OF HABEAS CORPUS

THOMPSON, District Judge.

Lester E. Morford, III, has tendered a Petition for Writ of Habeas Corpus. Petitioner was arrested on August 22, 1962, on suspicion of murdering one Jack A. Foster. On September 14, 1962, he waived preliminary hearing in the Justice’s Court, Reno Township. An Information was thereafter filed by the District Attorney on October 3, 1962 in the Second Judicial District Court of the State of Nevada, in and for the County of Washoe, charging Petitioner with murder.
