This case is before the Court on Defendant Teva Pharmaceuticals USA, Inc.’s (“Teva”) Motion for Summary Judgment (Doc. 37). For the following reasons, the Motion is denied.
I. FACTS
On January 16, 2006, Plaintiff Katelyn Weilbrenner was prescribed the antibiotic minocycline hydrochloride by her primary care physician, Dr. Robert Hawes, for treatment of acne.
