CASSIBRY, District Judge:

Plaintiffs seek injunctive relief and damages under the Truth In Lending Act, 15 U.S.C. § 1601 et seq., for defendant’s alleged failure to make certain disclosures required by the Act in the execution of a mortgage on plaintiffs’ home. The defendant has filed a motion to dismiss on the grounds of res judicata, estoppel, substantial compliance with the Act, and exempted transaction. Plaintiffs’ motion for preliminary injunction and defendant’s motion to dismiss came on to be heard on February 24, 1971. At that time, the Court granted the parties one week to file…
