Smith v. State

Supreme Court of Delaware

Decided December 18, 2008No. 339, 2008PublishedCited by 9 opinions

1Opinion of the Court

HOLLAND, Justice:

The defendant-appellant, Corey Smith, appeals from his Superior Court judgments of conviction for Attempted Robbery in the First Degree, Assault in the Second Degree, and Conspiracy in the Sec ond Degree. Smith contends that the Superior Court abused its discretion when it denied his request for a mistrial following a witness’s references to Smith’s criminal history and to plea negotiations between the State and Smith.

We have concluded that Smith’s arguments are without merit. Therefore, the judgments of the Superior Court must be affirmed.
