Appeal from a judgment of- the superior court for Spokane county, Hurn, J., entered April 12,1919, upon granting a nonsuit, dismissing an action for personal injuries sustained by an employee struck by a piece of steel while driving a wedge.

The plaintiff, Stevens, commenced this action in the superior court for Spokane county, seeking recovery of damages for personal injuries which he claims to have suffered while employed as a stationary engineer in the passenger car yard steam heating plant of the Great Northern Railway Company, in Spokane, while, the lines of that company were under the control of the defendant as United States director general of railroads.
