I. Introduction

On October 31, 2011, plaintiff Derek Sincere Black Wolf Cryer (“Cryer”), a state prisoner at the Souza-Baranowski Correctional Center (“SBCC”),1 filed a civil rights complaint pursuant to 42 -U.S.C. § 1983 alleging first amendment violations in connection with his free exercise of religion, and violations of the Religious Land Use and Institutionalized Persons Act (“RLUIPA”), 42 U.S.C. § 2000cc.
