BAKER, Judge.
The appellant was convicted in the District Court of Wichita County for the offense of murder, and his punishment assessed at twenty-five years in the penitentiary.
The record discloses that the appellant possessed and was cultivating a few acres in cotton just outside the city limits of Wichita Falls; that the deceased, J. E. Swayzee, was the owner of about fifty head of dairy cattle and was operating a dairy about a mile and a half from said cotton patch; that the cattle belonging to the deceased had been depredating upon said cot ton, and on the night preceding the killing,…
