On the twentieth day of February, 1946, Marie Josephine Peterson obtained an interlocutory decree of divorce from Glen O. Peterson, respondent below and plaintiff in error here, in the county court of Jefferson county, Colorado. By the terms of that decree the mother was awarded custody of their minor daughter, Glenda Jean, then approximately twenty months of age.
