The bill in this cause was filed in the late court of chancery, on the 24th day of April, 1846, by Charles Otway Mayne, of the county of Middlesex, in England, against George Griswold, of the city of Hew Tort. It set forth the incorporation of “The Morris Canal and Banking Company,” by the legislature of Hew Jersey, in 1824, with a capital of one million of dollars. This case presents several points of interest and importance; some of which are of no ordinary difficulty. They have been, elaborately and ably argued by the counsel for the respective parties, and the court has been .greatly aided in its judgment by their extensive and learned investigations.
