The primary issue is whether the Internal Hearing Unit of the Division of Workers’ Safety and Compensation (Division) was legally formed and whether it had jurisdiction to decide if Frank Sheneman’s request for a hearing to contest the Division’s final determination denying him worker’s compensation benefits was timely.
