By the Court.

It is contended by counsel for the city of Cleveland that Section 614-46, General Code, as applied to the facts of this case, and the action of the commission thereunder are unconstitutional.

Constitutionality of Appeal Statutes.

Counsel for the gas company urge that a consideration of the constitutional question^ presented in the brief of the city is precluded by reason of the fact that such questions were not raised before the commission and are not referred to or stated in the application for rehearing before the commission.
