Appeal by the defendant, Ward Robertson, from a judgment of . the County Court of Fulton county in favor of the plaintiff, entered in the office of the clerk of the county, of Fulton, upon the verdict of a jury rendered in March,. 1903, convicting the defendant of the crime of rape in the second degree.

1Opinion of the Court

Chase, J.:

The defendant was charged by indictment with the commission of the crime of rape in the second degree. The material part of the indictment is as follows: “ That the said Ward Robertson * * * on or about the 13th day of February, 1902, perpetrated an act of sexual intercourse with a férnale * * * being under the age of eighteen years * * * and not being the wife of the said Ward Robertson.” The crime was sufficiently stated in the indictment.
