J. E. Barsby, the defendant, gave to the McCaskey Register Company, plaintiff, a written order, dated Sept. 28, 1921, *437for “One Physicians & Surgeons System Style x31 finish 16,” referred to in the pleadings as a register, for which he agreed to pay $23 in cash with the order, and balance in twelve monthly instalments of $14.75 each. To secure this balance, defendant executed his promissory note, dated Sept. 28, 1921, payable to plaintiff’s order, in the sum of $177, in twelve monthly instalments of $14.75 each, beginning one month after date.
