Haymond, Judge:

This action of assumpsit was instituted November 28, 1945, in the Circuit Court of Monongalia County upon a policy of life insurance issued by the defendant, Metro politan Life Insurance Company, to the plaintiff, James Hanford. The plaintiff seeks a recovery for benefits claimed to have accrued to him under the provisions of the policy by reason of his alleged total and permanent disability, and for premiums paid by him, during the period January 13, 1928, to September 21, 1939.
