The Securities and Exchange Commission (“SEC”) brought this action against Kent Roberts (“Roberts”), a former Executive Vice President of McAfee, Inc. (“McAfee”), for various securities laws violations. During the course of discovery, Roberts identified written notes held by third-party attorneys Howrey, LLP (“Howrey”) that he contends are discoverable.
