This case is before the court on defendant’s motion to dismiss or in the alternative, for summary judgment. Because the motion incorporated other documents, it will be considered one for summary judgment. Summary judgment is appropriate only when there are no material issues of fact so that the moving party is entitled to judgment as a matter of law. RUSCC 56(c); Mingus Constructors, Inc. v.
