Claimant sues to recover for damage sustained to his automobile in the early morning of March 24, 1944, when said automobile, while being driven upon New York State Highway Route 9W, also known as Storm King By-Pass, in the town of Cornwall, Orange County, New York, by his son with his *182"consent and permission, collided with a quantity of earth and r.ock which had slipped or fallen' from an embankment on the west side of said highway, and on the traveled' portion thereof obstructing it.
