This suit was instituted by plaintiff in the district court of Hughes county, Okla., on February 24, 1932, for personal injuries. After the issues were joined and a trial was had on October 13, 1932, plaintiff obtained a verdict as against defendant in the sum of $12,000. From this judgment defendant prosecutes its appeal to this court.

The parties to this action will be referred to as plaintiff and defendant, as they appeared in the court below.
