State Farm Mutual Automobile Insurance Company (State Farm) instituted this declaratory judgment action seeking a determination by this court that a certain policy of automobile liability insurance issued by State Farm to Carlos Milam does not afford coverage to Andrew Milam for any damages for which he may become liable arising from an accident which occurred on June 17,1973. State Farm’s contention that coverage does not exist is based solely on the fact that it had no notice of the accident until nearly 10 months after the accident occurred,…
