Love Matthews, a prisonér in the penitentiary, serving a sentence of from 8 to 12 years under the indeterminate-sentence law, filed a suit for the writ of mandamus against Edward B. Everett, as Chairman of the State Board of Pardons and Paroles, and G. C. Byars and Mrs. Helen Williams Coxon, as members, to require them to consider and pass upon an application for a parole which he had previously filed with the board, but which the board had returned to him, stating in effect that under a recent decision of the Court of Appeals (Walker v.
