On May 31, 1904, appellee instituted this suit against appellant in the Randolph Circuit Court to quiet his title to certain real estate in- Randolph county, Indiana. The canse was venued to the Jay Circuit Court, where Ralph *158H. Clark, upon an intervening petition by' him filed, was admitted as a party defendant. The complaint was in one paragraph, answered by a separate general denial on the part of appellant and Clark.
