* Writ of error granted February 22, 1922. On the 5th day of June, 1918, the following instrument was executed by O. H. Evans and his wife, on the one part, and Jas. A. Weir, on the other part:
"Know all men by these presents: That I, C. H. Evans, joined herein by my wife, Mrs. Mary E. Evans, of the post office of Sonora, state of Texas, hereinafter called lessor (whether one or more), for and in consideration of $1,662.90, cash in hand paid, receipt of which is hereby acknowledged, do hereby lease unto James A.
