OPINION
NYE, Chief Justice.
This is a will construction case. Plaintiffs (the appellants herein), Leona Vasek Najvar, Emily Vasek Najvar and Robert Vasek, the only heirs-at-law and descendants of the testator, Frank Vasek, brought suit seeking a declaration that the devise of real property contained in the will had lapsed and should pass to them under the laws of descent and distribution because the sole devisee, Bohumil Vasek, the testator’s brother, had predeceased the testator.
