The appellant, as plaintiff, instituted, this suit, in the district court of Wichita county, Tex., against H. B. Hines and Cal T. Scott, as defendants, to recover of defendants damages alleged to have been occasioned plaintiff by reason of a trespass committed by the defendants upon plaintiff’s property.
