Plaintiff brought suit to adjudicate the waters of Devil Creek in Twin Falls county, the complaint alleging appropriations at various specified dates and in specified amounts by plaintiff and his predecessors in interest of the waters of said stream, and a use of such waters during the irrigation season of each and every year thereafter, and that the amounts thereof are necessary for the successful cultivation of the lands described.
