Plaintiff is a resident of the city of New York. Defendant is a Florida corporation. The defendant received authority to *591do business in this State on November 4, 1922, and in connection therewith designated one Evans, at 565 Fifth avenue, as the person to receive service of process on its behalf within the State. Some time prior to March 31, 1927, plaintiff sought to serve the summons on defendant's appointed agent but was unable to find him at the address indicated and was informed that the agent had removed to Florida.
