Plaintiff, David James Calabrese, has filed a motion to compel his automobile insurer, defendant, Colonial Insurance Company of California t/d/b/a Colonial Insurance Company of Wisconsin, a member of the Nationwide Insurance Enterprise, to submit to underinsured motorist arbitration and, in response, Colonial has requested a declaratory judgment that Calabrese affirmatively rejected UIM coverage under75Pa.C.S. §1731(c.l).
