Tbe plaintiff in error, A. Z. Holder, was indicted at tbe September, 1919, term of the circuit court for compounding a felony.
At tbe January, 1920', term tbe case was continued by consent. At the May, 1920, term tbe indictment was quashed upon motion of tbe attorney-general, and at tbe same term a new indictment was returned against tbe defendant for tbe same offense.
Tbe plaintiff in error resisted tbe motion of tbe State to quash tbe first indictment, and from tbe action of tbe court in so doing the plaintiff in error appealed to this court, and assigns tbe…
