BLACKBIRD, Justice.

This appeal involves two contracts pertaining to the Hacienda Holiday Motel, located at 3000 North Lincoln Boulevard, Oklahoma City. Both were entered into in January, 1959, by Alice M. Collins, plaintiff in error and owner of the lots comprising the motel’s site. The first one was for the motel’s construction on the lots and will hereinafter be referred to as Contract 1. The other party executing it was D. D. Baldwin, defendant in error, acting for Baldwin Construction Company, as contractor and builder.
