Plaintiff seeks to recover the difference between the disability retired pay of a lieutenant (junior grade) in the United States Navy which he has actually received since May 7, 1952, and that of a lieutenant to which he claims entitlement.1

*515While serving on active duty as a lieutenant (junior grade) in the United States Navy Eeserve, plaintiff was in August 1951 admitted to a Naval hospital with diagnosis undetermined (Tuberculoma — Eight Lower Lobe in Apex). Later that month he was transferred to another Naval hospital with diagnosis unchanged. On October 12, 1951, the diagnosis was changed…
