This is an action upon a promissory note. The note *292contained an authorization of confession of judgment. At first, judgment was taken by confession. It was after-wards vacated, and defendant given leave to file an answer. The case was tried upon the issues tendered by the defendant’s answer. At the close of the evidence, the court found for the defendant, and judgment was entered accordingly. The plaintiff has sued out this writ of error.
