KNIGHT, Justice.

This is a proceeding in the nature of a quo warranto brought by the State on relation of R. D. Algee and others against A. B. Hale, appellant here.

It is charged in the information that the defendant on or about the 7th day of February, 1937, “usurped, intruded into and now unlawfully holds or exercises the functions of a public, civil office in Jefferson County, Alabama, sometimes called Official Court Reporter for the civil division of the circuit court, * * * and that the defendant has continuously from towit, February 7th, 1937, to the date of this petition, usurped,…
