McMahan, J. —

This action was instituted by appellant against appellee to recover damages for personal injuries sustained by appellant by reason of the alleged negligence of appellee. The jury returned a verdict for appellant and answers to interrogatories. Appellee filed a motion for judgment in his favor on the interrogatories notwithstanding the verdict, and also a motion for a new trial. The motion for a new trial is not in the record.
