ROSZKOWSKI, District Judge.

This action comes before the court on the plaintiff’s appeal from the second Level I hearing officer’s order. For the reasons stated below, the court strikes Officer Ber-gana’s decision and finds that the MDC II conference and ease study evaluation are not in compliance with EHA requirements and the Level I hearing officer’s order and thus in violation of Section 1983.
