The district court ruled that it was without jurisdiction to entertain plaintiff’s employment discrimination suit under Title VII because plaintiff has not been issued a “right to sue” letter by EEOC. Plaintiff alleged that defendant entered into a settlement agreement with her and with EEOC but did not perform or tender performance of any part of the agreement. Despite defendants’ alleged total breach, EEOC informed plaintiff that its procedures do not allow for the issuance of a “right to sue” letter in cases where the parties have entered into a settlement…
