WILBUR, Circuit Judge.

This action was brought by Clinton L. Walker, appellee, to recover damages for the infringement of a patent, No. 1,575,239, issued to. him March 2, 1926, by the United States Patent Office for an improvement in method of counterbalancing engine main shafts, and to enjoin further infringement.
