Robin Carnahan, Missouri’s Secretary of State (Secretary), appeals from a judgment of the Cole County Circuit Court, which found that the Secretary’s summary portion of an official ballot title for an initiative petition was insufficient or unfair under section 116.190 1 and certified revised ballot language. During the pendency of this appeal, the signature submission deadline for inclusion on the November 2008 ballot passed without the proponents of the initiative submitting any signatures to the Secretary.
