THE COURT.
Before the court of appeal, which had original jurisdiction of this case, the following decision was rendered by Hart, J.:
“This is an action for damages for injuries alleged to have resulted to an automobile owned by the plaintiff from the negligence of the defendant.
“The accident resulting in the alleged damage to the automobile occurred at Woodland, Yolo County, between the hours of 8 and 9. o’clock in the morning of August 26, 1914. The complaint states that the automobile was a Westcott four-passenger machine of the value of $925, and alleges that on the day mentioned, ‘while…
