This matter is before the Court on the plaintiff’s motion for a preliminary injunction and the defendants Glen M. Melby and Dale Akerman’s motion for summary judgment. 1 Pursuant to Federal Rule of Civil Procedure 65(a)(2), the trial on the merits was advanced and consolidated with the hearing for a preliminary injunction. This memorandum incorporates the Court’s findings of fact, conclusions of law, and order for judgment as required by Federal Rule of Civil Procedure 52(a).
