Cross appeals from a judgment of the Supreme Court (Monserrate, J.), entered February 15, 2001 in Broome County, which, inter alia, converted petitioner’s application, in a proceeding pursuant to CPLR article 78, into an action for declaratory judgment and declared that an agreement entered into between the parties was valid and enforceable.
