MEMORANDUM AND ORDER

“The bottom line is that poor people are the ones that use crack cocaine and mostly minorities.” 1
For more than a decade, I have been deeply troubled by, and have written critically about, the crack cocaine Guidelines. See, e.g., United States v. McMurray, 833 F.Supp. 1454 (D.Neb.1993).
