After a jury trial, David Tabor was convicted of conspiracy to distribute and possess with intent to distribute fifty grams or more of a mixture or substance containing cocaine base (crack cocaine) in violation of 21 U.S.C. §§ 841(a)(1), 841(b)(1), and 846. The district court 1 found him responsible for at least one kilogram of cocaine base and sentenced him to 200 months imprisonment with five years of supervised release.
